Legal determinants of the UE - Directives

Directive 1999/62/EC of the European Parliament and of the Council of 17 June 1999 on the charging of heavy goods vehicles for the use of certain inhttps://eur-lex.europa.eu/frastructures

Replaces earlier legislation - Directive 93/89/EEC - which was repealed by the Court of Justice in 1995. Harmonises the conditions under which national authorities may levy taxes, tolls and user charges on goods transported by road. In addition, it points to revenue allocation mechanisms, supporting the earmarking of additional revenue for investments directed towards achieving sustainable transport goals, such as new technologies in vehicle design or infrastructure. Directive (EU) 2019/520 of the European Parliament and of the Council of 19 March 2019 on the interoperability of electronic toll collection systems and facilitating the cross-border exchange of information on non-payment of tolls within the Union

The Directive lays down the necessary conditions to:
(a) ensure the interoperability of electronic tolling systems across the Union road network, including urban and interurban motorways, major and minor roads, and various facilities such as tunnels or bridges, and ferries;
(b) facilitate the cross-border exchange of vehicle registration data for vehicles and vehicle owners or holders affected by the non-payment of tolls of any kind in the Union.

Commission Implementing Regulation (EU) 2020/204 of 28 November 2019 on the detailed obligations of providers of the European Electronic Toll Service, the minimum content of information on the European Electronic Toll Service area, electronic interfaces, requirements for interoperability constituents and repealing Decision 2009/750/EC

The regulation completes the legal framework ensuring interoperability of electronic tolling systems. It establishes specific requirements with regard to the obligations of European Electronic Toll Service (EETS) providers, the content of EETS domain information, electronic interfaces and requirements for interoperability constituents.

Act of March 21, 1985 on Public Roads

It regulates the rules for the division of public roads, road administration and issues related to electronic toll collection, which allows for a comprehensive definition of, among other things, the vehicles subject to electronic toll collection, defines the issues of fines, penalties, and regulates the EETS service. Act of 27 October 1994 on toll motorways and the National Road Fund

It sets out the rules for financing the construction of toll motorways and national roads from the National Road Fund, the rules for the conclusion of construction and operation contracts and the collection of motorway tolls. Act of 15 April 2021 amending the Act on toll motorways and the National Road Fund and certain other acts

It regulates issues related to, inter alia, motorway toll on concession sections, payment of toll electronically by transmitting geolocation data to the KAS SPOE, purchase of an electronic motorway ticket, designation of the Head of KAS as the authority controlling the correctness of payment of motorway toll from users of light vehicles, as well as in the mode of control carried out on the road.

Legal national conditions - Regulations

Regulation of the Minister of Infrastructure of 31 August 2022. on specific tasks of competent authorities related to the entry of vehicles into service and templates of related documents.

The regulation regulates the detailed activities of the authorities in matters related to the admission of a vehicle to be used in traffic and specimens of relevant documents.

Regulation of the Minister of Infrastructure of 2 June 2021 on the control of the correct payment of the electronic toll by the Chief Inspector of Road Transport

Specifies the detailed procedure, method and scope of the control of the correct payment of the electronic toll carried out by the Chief Inspector of Road Transport, including the control of the device used in the vehicle for the purpose of collecting the electronic toll.

Regulation of the Council of Ministers of 22 March 2011 on national roads or their sections, on which electronic tolls are collected, and the rates of electronic tolls

It identifies national roads or their sections of A, S, GP and G class on which electronic tolls are levied and specifies the rates of electronic tolls.

Regulation of the Council of Ministers of 16 July 2002 on toll motorways

It defines the motorways that will be built and operated as toll roads.

Ordinance of the Minister of Finance, Funds and Regional Policy of 5 July 2021 on the designation of the National Revenue Administration body to perform certain electronic toll collection tasks

Concerns the appointment of the Director of the Tax Chamber in Łódź to perform tasks in the area of electronic fee collection (inter alia, ascertaining whether the data entered in the register of electronic toll payers at the stage of self-registration in the KAS ETCS, which were not confirmed during authentication, are consistent with the documents attached to this register), deletion of data, notification of their deletion and acceptance, digitally reproduced, of proxies submitted to the register.

Announcement by the Minister of Finance, Funds and Regional Policy of 22 June 2021 on information on the launch of the KAS Electronic Toll Collection System

Specifies the deadline for the launch of the ICT system for the collection of the electronic toll by the Head of KAS.

Announcement by the Minister of Infrastructure of 29 November 2022 on electronic toll rates for 2023

Sets out the toll rates per kilometre of motorway by vehicle category that are applicable in 2023.

Announcement from the Minister of Finance, Funds and Regional Policy of 28 July 2021 on information related to electronic toll collection using short-range communication (DSRC) technology

Sets the date of termination of the electronic tolling system using DSRC technology for vehicles with a maximum permissible weight of more than 3.5 tonnes, including buses irrespective of their maximum permissible weight, and the date of termination of the possibility of acquiring and using equipment for electronic toll collection using short-range communication (DSRC) technology.
