Electronic toll payments on e-TOLL are controlled on the basis of the Public Roads Act of 21 March, 1985. The General Inspector of Road Transport is authorized to verify the validity of electronic toll payment, specifically to control a mobile device, an external location system or an GNSS data transfer on-board unit used in a vehicle, to impose and collect fines. Customs & Treasury Service officers, within the framework of performance of their statutory duties, are also entitled to verify the validity of electronic toll payment, specifically to control a mobile device, an external location system or an GNSS data transfer on-board unit used in a vehicle.

The purpose of verifying electronic toll payments is to ensure fair treatment of users required to pay electronic toll for driving on national roads, and to deliver the proceeds from collected electronic toll to the National Roads Fund, as necessary for construction and maintenance of national roads.

If any violation of electronic toll provisions of the Public Roads Act is discovered through verification/control, the General Inspector of Road Transport imposes an administrative fine on the owner, holder or user of the vehicle or on another road user who is not the owner, holder or user of the vehicle. Such a fine can also be imposed on the vehicle driver in the event of wrong vehicle category input in the OBU.

A vehicle owner, holder or user, or a road user who is not the owner, holder or user of the vehicle, can be punished with no more than one fine for the particular violations concerning a particular motor vehicle, specifically:

  • Non-fulfillment of the obligation to pay electronic toll,
  • Misuse of a mobile device, external location system or on-board unit if inadequate toll is paid as a result,
  • Failing to register a vehicle or a combination of vehicles with maximum authorized mass >3.5 tonnes in the registry of electronic toll payers,
  • Entering inaccurate data of a vehicle or combination of vehicles and reference number of the on-board equipment used in the vehicle in the registry of electronic toll payers,
  • Failing to attach digital reproductions of the following documents in the registry of electronic toll payers: confirmation of motor vehicle data if such data were not reported to the central registry of vehicles; confirmation of submission of a cash deposit security or collateral document (for postpaid services),
  • Failing to update the details in the registry of electronic toll payers,

if these are discovered during a single 24-hour period.

Driver of a motor vehicle can be punished with no more than a single fine for failing to input correct vehicle category details in the mobile device, external location system or on-board unit, discovered during a single 24-hour period.

Each 24-hour period starts on 0:00 and ends on 24:00.

A fine for non-fulfillment of the obligation to pay a prepaid electronic toll will not be imposed if geolocation data was transmitted to the National Revenue Administration's Electronic Toll Collection System and the owner, holder or user of the vehicle paid the electronic toll within 3 days after the end of the driven route. Details of any outstanding toll payment can be found in the National Revenue Administration's Electronic Toll Collection System.

In case of a suspected violation that may result in a fine being imposed on a foreign entity having a place of business or place of residence in a country that does not have an agreement in place with Poland on cooperation in mutual pursuit of financial claims, or where claim enforcement opportunities do not transpire directly from international legislation and the legislation of such a third country, the verification/control officer will charge a deposit in the amount corresponding to the anticipated amount of administrative fine.

A vehicle driver can be punished with a fine for an offence in the event of confirmed violation of the Public Roads Act. Fines for offences can be imposed and collected by Road Transport Inspection officers and Customs & Treasury Service officers.

Non-fulfillment of the obligation to ensure proper functioning of a mobile device or an on-board unit with software, discovered during verification/control - a fine for an offence will be imposed on the driver of the motor vehicle. If a GNSS or data transmission interruption exceeding 15 minutes is discovered. The motor vehicle driver has to promptly stop at the nearest vehicle parking lot or in the nearest parking bay, or will promptly exit the road on which electronic toll is collected. The vehicle driver may restart driving on a road where electronic toll is collected as soon as GNSS or data transmission signal is restored.

 

This regulation does not apply if the National Revenue Administration's Electronic Toll Collection System is not available.
